Official Rules

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

The Official Rules ("Rules") prevail in the event of any conflict or inconsistency with any other communications including advertising or promotional material. Entry/claim instructions are deemed to form part of the Rules and by participating in this promotion ("Promotion") all claimants will be deemed to have accepted and be bound by these Rules. Please retain a copy for your records.

Sponsor: Dynata, LLC ("Sponsor" and "Host"), having a principal place of business at 4 Research Drive, Suite 300, Shelton CT 06484 USA. Judge: Winner will be selected by Sponsor at random from all eligible entries received via a randomized computer process which will be carried out on or about seven (7) working days after the close of the Promotion Period. The Sponsor is responsible for the delivery of the Prize(s) to the Winner(s).

Sponsor takes data protection seriously. By entering this Promotion, you confirm that you have read the Privacy Policy, and agree to these Rules. By joining and submitting any information required as part of their participation in the campaign, entrants agree to their information being held and processed in accordance with Privacy Policy and all applicable laws.

Eligibility: the Burlington / eRewards Back-to-School Sweepstakes (the "Sweepstakes") is open only to legal residents of the fifty (50) United States (and D.C.) and Puerto Rico who are at least eighteen (18) years old at the time of entry, have a computer or mobile device, and have access to the internet. Entrants under the age of majority in their state of residence (a "minor") may not enter the Promotion. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited.

To participate, the entrant must have received notification directly from Sponsor inviting them to participate in the Promotion, and subsequently registered as a new member for free as a Burlington panelist.

Persons in any of the following categories are NOT eligible to participate or win prizes in the Promotion:
1. Any person who on or after July 16, 2024, was or is an owner or employee, director, officer, agent, or independent contractor of Dynata, LLC. and/or Burlington Store, Inc., their affiliate or parent companies or service agencies, and any entities retained by Sponsor for the administration of the Promotion, as well as the immediate family (spouse, parents, siblings and children) and household members of each such individual as listed above;
2. individuals who are engaged in the development, production or distribution of Promotion materials or the prize supply for the Promotion; and
3. Any person outside the 50 United States, D.C. or where prohibited.
Acceptance of Sweepstakes Official Rules. Participation constitutes entrant's full and unconditional agreement to these Official Rules and Sponsor's, Host's and Judge's decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.

By agreeing to participate in this Promotion you expressly agree to be bound by these Sweepstakes Rules. "Burlington", as used in these rules, means a panel conducted by Dynata LLC Group, LLC including one or more of its affiliates and subsidiaries and their successors and assigns. If you do not agree to be bound by these Sweepstakes Rules, do not join the program or please contact us using the contact page with your Burlington registered email address and we will exclude you from the Sweepstakes.
Timing: The Sweepstakes begins July 16, 2024, at 12:00 a.m. Eastern Daylight-Saving Time ("EDT") and ends on July 31, 2024, at 11:59 p.m. EDT (the "Promotion Period"). Sponsor's computer is the official time-keeping device for the Sweepstakes.
How to Enter: During the Promotion Period,
1. Entrant must create a new Burlington Panelist account.
2. For each qualifying online survey completed during the Promotion Period, an additional entry will be submitted for each (LIMIT: 10 entries per eligible entrant during Promotion Period).
Alternate Form of Entry: During the Promotion Period, eligible entrants will automatically receive one (1) entry to the Sweepstakes for a chance to win one Prize, as described below, by emailing their name, valid email address, valid mailing address, and valid phone number to SWEEPSTAKES@DYNATA.COM with BURLINGTON / E-REWARDS BACK-TO-SCHOOL SWEEPS in the Subject Line, that states the following:

"I would like to enter the Burlington Promotion without registering for Burlington and/or completing a survey. I have read, understand, and agree to the Rules of the Promotion. I understand and agree that I am providing my personal information to the Promoter of this Promotion and that my personal information will be stored on servers in the United States and used only for purposes of administering the Promotion, subject to the Promoter's Privacy Policy."

Upon Sponsor's receipt of the email entry, the entrant will receive one (1) entry into the Promotion. Maximum 10 entries per person entering the Promotion regardless of the method of entry. All entries must be received by the end of the Promotion Period.

Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant's entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each potential winner may be required to show proof of being an authorized email account holder. Email entrants will automatically be entered for a chance to win the Prize, as described below. All emailed entries must be received in Sponsor's designated email box by July 31, 2024, at 11:59 p.m. EDT to be considered.
Prize Drawing: Judge’s decision as to the selection of the potential winners are final and binding in all matters related to the Sweepstakes. Judge will randomly select one (1) potential winner from all eligible entries submitted through account creation, survey completions, and via email at the conclusion of the Promotion Period. The potential winner will be notified via email to the email address assigned to the respective Burlington account, approximately seven (7) working days following the close of the Promotion Period. If a potential winner of a prize cannot be contacted or the prize is returned as undeliverable, the potential winner forfeits the prize. Receiving a prize is contingent upon compliance with these Official Rules. If a potential winner is disqualified for any reason, Sponsor may, in its sole discretion, award the prize to an alternate winner by random drawing from among all remaining eligible entries from the applicable Promotion Period. Odds of winning a prize depend on the number of eligible entries received during the Promotion Period.
Prize: Each winner will receive two (2) $250 Burlington Gift Cards (or e-Gift cards) (terms and conditions apply) with an approximate retail value (AVR) of $500. Approximate Retail Value of all prizes combined: $500. Prize may not be substituted except at the Sponsor's sole discretion. Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winner is responsible for all taxes and fees associated with prize receipt and/or use.
Release: By receipt of any prize, winners agree to release and hold harmless Sponsor, Host, Judge, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of any prize.
Publicity: Except where prohibited, participation in the Sweepstakes constitutes the consent of winner(s) to Sponsor's and its agents' use of winners' name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.
Tax Information: Prize winner is responsible for all federal, state, local and income taxes associated with winning prize.
General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to, malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Sweepstakes, if it is possible. If the Sweepstakes, or any part of it, is discontinued for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
Disputes: All issues and questions concerning the construction, validity, interpretation and enforceability of thee Rules or the rights and obligations of the entrant, or Sponsor in connection with the Promotion shall be governed by and construed in accordance with the internal laws of the State of Connecticut giving effect to any choice of law or conflict of law rule or provisions that would cause the application of any other state's laws.
Arbitration Disclosure: By participating in this Promotion each eligible entrant agrees that:
1. any claim, dispute, or controversy (whether in contract, tort, or otherwise) entrant may have against the Promoter and any parent company, subsidiaries, and affiliates, and each of their respective officers, directors, employees and agents (collectively, the "Releasees") arising out of, relating to, or connected in any way with the Promotion, the awarding or redemption of prizes, or the determination of the scope or applicability of this agreement to arbitrate, will be resolved exclusively by final and binding arbitration administered by American Arbitration Association ("AAA") and conducted before a sole arbitrator pursuant to the AAA Consumer Rules ("Rules and Procedures");
2. this arbitration agreement is made pursuant to a transaction involving interstate commerce and shall be governed by the Federal Arbitration Act ("FAA"), 9 U.S.C. §§ 1-16;
3. the arbitration shall be held at a location determined by AAA pursuant to the Rules and Procedures (provided such location is reasonably convenient for entrant), or at such other location as may be mutually agreed by the entrant and Promoter;
4. the arbitrator's decision shall be controlled by the terms and conditions of these Sweepstakes Rules and any of the other agreements referenced herein that the applicable entrant may have entered into in connection with the Promotion;
5. the arbitrator shall apply Connecticut law consistent with the FAA and applicable statutes of limitations, and shall honor claims of privilege recognized at law;
6. there shall be no authority for any claims to be arbitrated on a class or representative basis, arbitration can decide only the entrant's and/or Promoter's individual claims; the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated;
7. if the entrant is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Promoter will pay as much of the entrant's filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive; and
8. if any part of this arbitration provision is deemed to be invalid, unenforceable or illegal, or otherwise conflicts with the Rules and Procedures established by AAA, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. Entrant's Personal Information: Entrants' data will be collected, stored and processed for the purposes of administering and assessing this Promotion only and for future Promotions (at the option of the entrant) and for the fulfilment of the prize, which may involve the exchange of information with third party service providers. All personal information will be handled in accordance with the Promoter's Privacy Policy.
Winner List: For the name and state of the winner, send an email request to SWEEPSTAKES@DYNATA.COM within one month from the end of the Promotion Period, referencing Burlington Sweepstakes – July 2024.
